W związku z realizacją wymogów Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych – dalej jako RODO), informujemy o tym, w jaki sposób przetwarzamy Państwa dane osobowe.
RODO wprowadza podstawowe zasady prawa ochrony danych osobowych, jakie podmioty gospodarcze są zobowiązane zapewnić w odniesieniu do danych swoich klientów, pracowników oraz kontrahentów, a także określa, w jaki sposób podmioty te mogą przetwarzać posiadane dane osobowe. Z racji, że nadal chcielibyśmy pozostawać z Panią/Panem w kontakcie poniżej przesyłamy stosowną informację wymaganą przepisami RODO:
I. Administratorem Pani/Pana danych jest Byars Industries Poland sp. z o.o., z siedzibą w miejscowości Michałów-Reginów (05-119), ul. Polna 10, wpisana do rejestru przedsiębiorców prowadzonego przez Sąd Rejonowy dla m.st. Warszawy w Warszawie, XVI Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem KRS: 0000211779, NIP: 5240401244, REGON: 011523620, kapitał zakładowy 10 800 000,00 zł wpłacony w całości (dalej jako „Administrator”).

III. Dane osobowe przetwarzane są w celu:
a) realizacji umowy lub podjęcia działań na żądanie osoby, której dane dotyczą, przed zawarciem umowy (podstawa prawna: art. 6 ust. 1 pkt. b RODO);
b) obsługi zapytań (art. 6 ust. 1 pkt. f RODO);
c) obsługi reklamacji i skarg (art. 6 ust. 1 pkt. b RODO);
d) przechowywania dokumentacji i spełnienia obowiązków prawnych ciążących na Administratorze (art. 6 ust. 1 pkt. c RODO);
e) przesyłania informacji marketingowych – odbywa się to na podstawie udzielonej zgody o ile została wyrażona (art. 6 ust. 1 pkt. a RODO);
f) monitorowania i poprawy jakości świadczonych usług (art. 6 ust. 1 pkt. f RODO).
IV. Państwa dane osobowe, co do których jesteśmy Administratorem zostaną ujawnione pracownikom lub współpracownikom Administratora, jak też powierzone podmiotom trzecim, które udzielają wsparcia Administratorowi w prowadzonej działalności, na zasadzie zleconych usług i zgodnie z zawartymi umowami powierzenia danych osobowych do przetwarzania, w tym dostawcom usług IT, operatorom pocztowym lub przewoźnikom w celu dostarczenia zamówień, dystrybutorom lokalnym, doradcom zewnętrznym (np. biura tłumaczeń, kancelarie prawne, biura księgowe, biegli rewidenci), a także podmiotom uprawnionym do uzyskania danych na podstawie obowiązującego prawa np. sądom lub organom ścigania – oczywiście tylko, gdy wystąpią z żądaniem w oparciu o stosowną podstawę prawną.
V. Administrator korzysta z różnych rozwiązań informatycznych, które pozwalają na świadczenie usług i sprawniejszą obsługę oraz współpracuje z podmiotami wspierającymi go w procesach biznesowych i informatycznych (tzw. procesorzy danych).
VI. Podanie danych jest dobrowolne, a jeżeli jest wymagane to jest to wyraźnie wskazywane przez Administratora (realizacja umowy, rozpatrzenie reklamacji, obsługa zapytania), bądź wymagane przepisami prawa (np. w zakresie weryfikacji Państwa danych).
VII. Dane osobowe będą przetwarzane przez okres niezbędny do realizacji wskazanych celów (np. do czasu cofnięcia zgody lub w przypadku podania danych dla potrzeb realizacji umowy do czasu rozwiązania Umowy) w celu pierwotnym. Cel wtórny przetwarzania obejmuje wyłącznie przetwarzanie na potrzeby dochodzenia, ustalenia lub obrony roszczeń prawnych i powstaje po ustaniu przesłanki (np. cofnięcie zgody lub rozwiązanie umowy). Okres przetwarzania w celu wtórnym przedawnia się z upływem podstawy do wniesienia roszczeń lub archiwizowania dokumentów na potrzeby realizacji przepisów prawa.
VIII. Dysponuje Pani/Pan prawem do cofnięcia zgody na przetwarzanie danych osobowych w dowolnym momencie, bez względu na wyrażoną zgodę, bądź sposób przetwarzania w ramach tej zgody.
IX. Ma Pani/Pan prawo dostępu do swoich danych osobowych, ich sprostowania, usunięcia lub ograniczenia przetwarzania, w tym prawo do wniesienia sprzeciwu wobec przetwarzania, a także prawo do przenoszenia danych i wniesienia skargi do organu nadzorczego, którym po 25 maja 2018 r. będzie „Prezes Urzędu Ochrony Danych Osobowych”.
X. Niewniesienie przez Panią/Pana sprzeciwu, bądź niecofnięcie uprzednio wyrażonych zgód na przetwarzanie danych osobowych do celów marketingowych w terminie 14 dni od momentu otrzymania przedmiotowej informacji, uważane będzie za wyrażenie stosownych zgód w ww. zakresie.

The GDPR introduces the basic principles of personal data law protection, which economic entities are obliged to provide in relation to the personal data of their clients, employees and contractors, as well as specifies how these entities can process their personal data. 3. Personal data is processed in order to:
a) performance of the contract or taking action at the request of the data subject, before concluding the contract (legal basis: Article 6 paragraph 1 point b of the GDPR),
b) Service requests (Article 6 paragraph 1 point f of the GDPR),
c) handling complaints (Article 6 item 1 point b of the GDPR),
d) storing documentation and fulfilling legal obligations incumbent on the Administrator (Article 6 (1) (c) of the GDPR),
e) sending marketing information - this is done on the basis of the granted consent, if it has been expressed (Article 6 paragraph 1 point a GDPR),
f) monitoring and improving the quality of services provided by Administrator (Article 6 (1) point f of the GDPR).
4. Your personal data about which we are the Administrator will be disclosed to the Administrator's employees or associates, as well as entrusted to third parties who provide support to the Administrator in their business, on the basis of outsourced services and in accordance with the contracts entrusted to entrust personal data for processing, including IT service providers , postal operators or carriers to deliver orders, local distributors, external consultants (eg translation offices, law offices, accounting offices, auditors), as well as entities authorized to obtain data under applicable law, e.g. courts or law enforcement authorities - of course only when they make a request based on an appropriate legal basis.
5. The administrator uses various IT solutions that allow for the provision of services and more efficient service, and cooperates with entities supporting it in business and IT processes (so-called data processors).
6. Providing the data is voluntary, and if it is required, it is clearly indicated by the Administrator (performance of the contract, consideration of complaints, handling inquiries) or required by law (eg. in the scope of verification of your data).
7. Personal data will be processed for the period necessary to achieve the indicated goals (eg. until withdrawal of consent or in the event of providing data for the purposes of the contract until the termination of the Agreement) for the original purpose. The secondary purpose of the processing includes only processing for the purpose of investigation, determination or defense of legal claims and arises after termination of the condition (eg. withdrawal of consent or termination of the contract). The processing period for the secondary purpose is time-barred with the expiration of the basis for filing claims or archiving documents for the purposes of implementing the law.
8. You have the right to withdraw your consent to the processing of personal data at any time, regardless of the consent given, or the method of processing under this consent.
9. You have the right to access personal data, rectify, delete or limit their processing, the right to objection, the right to transfer data, the right to lodge a complaint with a supervisory authority.
10. If you do not raise your objection, or you do not withdraw your consent to the processing of your personal data for marketing purposes within 14 days of receiving this information, you will be deemed to have given consent in the abovementioned range.
